4. Ownership of Work & Intellectual Property
Unless otherwise specified in the contract:
Clients retain ownership of their data at all times.
Work products such as code, documentation, dashboards, models, or analyses produced specifically for a client become that client’s property upon payment.
Fundamentum retains the right to reuse generalized, non-client-specific processes, patterns, or frameworks that do not include proprietary client information.
5. Confidentiality
We treat all client data, communications, and project materials as strictly confidential. Confidential information will not be shared with any third party except:
When required for delivery of services and explicitly approved by the client, or
When required by law.
6. Payment & Billing
Payment terms are defined in each project agreement or invoice. Late or unpaid invoices may delay delivery of services. All fees are non-refundable unless otherwise stated in the project contract.
7. Limitation of Liability
Fundamentum provides services using industry best practices, but cannot guarantee specific business outcomes.
To the maximum extent permitted by law, Fundamentum is not responsible for:
Losses resulting from client misuse of data or systems,
Issues caused by third-party platforms or tools,
Indirect or consequential damages.
Our total liability is limited to the value of the services paid for in the relevant engagement.
8. Termination
Either party may terminate a consulting engagement according to the terms outlined in the signed agreement. Upon termination, clients must pay for all completed work and any work in progress up to the termination date.
9. Third-Party Tools & Services
Our services may involve the use of third-party software or platforms. Clients remain responsible for maintaining licenses, permissions, and compliance with third-party terms.
10. Changes to These Terms
We may update these Terms of Service periodically. The newest version will always be posted on this page and will apply from its effective date.
